My Comment/Question #1 – Fingerprint ‘Requirement’ – Types of Trespass? I work in technical support at a company that sells online products to those in the legal society. The man who at times acts as my manager informed me recently that one of the upcoming ‘requirements’ of employees will be to provide our finger prints. My initial response was a verbal conversation with my manager – a short statement to the effect that i am a woman who at times acts as an employee and that the body of i is the property of i, exclusive of all others. To protect said property, i: a woman do not agree to provide my finger prints. He has not mentioned the topic since then so perhaps this was sufficient to dissolve the controversy. If he does so later on, then (if necessary) I will perhaps submit a written correspondence and/or notice (to the man or woman who at times acts as HR manager perhaps) that goes into more detail – somthing along the lines of … i, state that i, wish not to accept any order of you, or any order of those acting under your authority now or in the future to submit to any forced application of material on or into the body of i, specifically the finger tips of i for the purpose of creating prints that are accessible to the company and/or the legal society. i, state that i, consider any forced application of material on or into the body of i, specifically the finger tips of i for the purpose of creating prints to be a choice and believe this may cause i, harm; i, state that any attempt to force and/or coerce i, to apply material on or into the body of i, specifically the finger tips of i for the purpose of creating prints will be seen as trespass by way of harm; My question is, if hypothetically (though unlikely), the company ends my employment as a result of my refusal to provide my finger prints – then how could I define the trespass at that point in any subseqent correspondence or notice – would it be by way of extortion, or some other term? Several lawful terms associated with the various types of trespass were provided in the LFMKS. It would be helpful to have a comprehensive list of these terms so that when I find the need to remove controversy and/or request/provide remedy in various circumstances I can more readily and accurately define the type of trespass. In a similar vein, is it sufficient to simply state that i consider some action to be a trespass (period)? What I mean is – it is necessary to follow the word ‘trespass’ with the phrase ‘by way of…’ ?
