in the case of wo/man who did witness the incident are they sent a summons in the same way as the wo/man who did trespass?

if you are fortunate enough to have a witness to the incident that you claim to be a trespass would the wo/man be compelled to attend the court of i with penalties for not attending (which may "put their backs up"). Inexperienced, I don't know what happens in the legal system to compel witnesses to attend.
